14. Hyperion had secured access to the re-worked code to OS 3.1 from Olaf
Barthel nearly one month before it entered into the Agreement with amiga,
and Hyperion therefore had all the source code nevessary to develop OS
4.0. Mr. Barthel, a one-time contractr for ESCOM, saw that the AMiga OS
build process wasvery messy and on his own accord, and without any
license or instruction, wrote a modern version of OS 3.1 that could be
used on a PC rahter than a Sun wrkstation. I found out about Mr. Barthel's
own build version of OS 3.1 while I was working at Gateway on Amiga OS 3.5.
I recommended to the than Manager of Gatway, Jeff Schindler, that he pay
Mr. Barthel and obtain his version of OS 3.1. Mr. Schindler told me that
he had paid Mr. Barthel and I only found out a few years later that he had
not done so.


It is time to sue Gatway now, as they sold something they didn't own or owned.

Yeah - but the company that bought the Amiga assets from Gateway was AInc(W).

AInc(W) is now defunct.

The current AInc(D) can't sue Gateway.
They could sue KMOS, KMOS could sue ITEC, ITEC could sue AInc(W) and AInc(W), if they were still in business, could then sue Gateway...

No, because Amiga Inc. Delaware ist the former KMOS. They just renamed themselves.

No, because Amiga Inc. Delaware ist the former KMOS. They just renamed themselves.


O.K. - if they don't want to sue themselves, they could sue ITEC in the meantime...
